The Ethics Board convened on March 20, 2019 to discuss Alice Taylor’s appeal against Shqiptarja.com.

The complainant complains that the information provided in the article (link: Https://shqiptarja.com/lajm/lereni-alicen-te-shijoje-jeten-ne-shqiperi?r=pop5s) is incorrect, based on speculation.

The Board analyzed the article and came to the conclusion that a number of articles of the Code of Ethics were violated:

1. Accuracy and Fairness of Information

1 / A Accuracy. This article has been violated because the information is not verified and is misleading.

1 / B Unbiased Journalism. The information is clearly biased.

2. Distinguishing Fact from Opinion

Arguments on journalist Taylor are built on opinions not facts.
Frazat “works for the Russian press from Albania”, “employed by PD (party)”, “Directed by the Political Advisor of Lulzim Basha…” are opinions, no facts.

The phrase: “Creates a dubious background for security services” and the phrase “permission of stay is not granted… confidential sources say they have not renewed it” is an opinion rather than a fact.

9. Intrusion into private life

The Article has personal insults such as “mediocre (“e dobët”) journalist” or “aggressive”.

11. Incitement to Crime and Violence

By treating her as a Russian agent, accompanied with her picture, the journalist is put at risk of becoming a target of violence.

RECOMMENDATION

We recommend that portals that have released these news must take them down or/and take them out of circulation.

Ankimuesja ankohet që informacionet e dhëna nuk janë korrekte, i bazuar mbi spekulime.
Bordi analizoi shkrimin e gazetës dhe ankesën dhe arriti në konkluzionin se në artikullin e reklamuar nga ankimuesja, janë shkelur një sërë nenesh të Kodit të Etikës:

Frazat “punon për shtypin rus nga Shqipëria”, “e punësuar pranë PD”, “Drejtuar nga Këshilltari politik i L. Bashës…” janë opinione, nuk janë fakte.

Fraza: “Krijon një sfond të dyshimtë për shërbimet e sigurisë” dhe fraza “leja nuk është e rinovuar… burime konfidenciale shprehen që nuk ia kanë rinovuar”, përbën opinion dhe jo fakt.

9 – Ndërhyrja në jetën private

Shkrimi ka dhe fyerje personale, (“gazetare e dobët”).

11 – Nxitja e Krimit dhe Dhunës

Duke e trajtuar si agjente ruse, shoqëruar me foton e saj, gazetarja rrezikon të bëhet target dhune.

REKOMANDIMI

Rekomandojmë që portalet që kanë publikuar këto lajme t’i heqin nga qarkullimi dhe t’i nxjerrin offline.

AMC talks ethics at the newsroom of Syri.net

The Albanian Media Council has launched a friendly tour through several news media outlets to talk to journalists about ethics in the media. This tour comes after last year’s troubling findings, where in 40 media the average violation of ethics was 9 (violations) a day.

The last meeting was held at the Syri.net editorial board with the presence of 2 experts of ethics, Mr. Mark Mark and Mr. Sokol Shameti.

One of the points that was discussed was one of the most common violations in online media and that was “presumption of innocence and reporting of judicial practices”. In many cases, journalists consider the individual to be a criminal even though there is no court decision that he is. According to the Albanian Code of Ethics of Journalist no one should be considered guilty without a court decision.

This highly productive meeting for Syri.net journalists’ daily work, is part of a project supported by OSFA and the EU.

Këshilli Shqiptar i Medias ka nisur një turne miqësor nëpër disa redaksi mediash të reja për të biseduar me gazetarët për etikën në media. Ky tur vjen pas gjetjeve shqetësuese të monitorimit të vitit të kaluar ku në 40 media mesatarja e shkeljeve të etikës ishte 9 (shkelje) në ditë.

Takimi i radhës u bë në redaksinë e Syri.net dhe në takim ishin 2 ekspertë të etikës, z. Mark Marku dhe z. Sokol Shameti.

Një nga pikat që u diskutuan ishte dhe një nga shkeljet më të rëndomta që bëhen në mediat online dhe që ishte “(mos)prezumimi i pafajësisë dhe raportimi i praktikave gjyqësore”. Në shumë raste, gazetarët e konsiderojnë kriminel individin e raportuar nga policia edhe pse nuk ka një vendim gjykate që e konsideron të tillë. Sipas Kodit shqiptar të Etikës së Gazetarit askush nuk duhet konsideruar fajtor pa marrë më parë një vendim gjykata.

Takimi, shumë produktiv për punën e përditshme të gazetarëve të Syri.net, është pjesë e një projekti të mbështetur nga OSFA dhe BE.

Selfregulation – AMC starts touring the cities

In the next eight months, Albanian Media Council will launch a tour through university cities of Albania to promote self-regulation.

The purpose of these meetings is to speak with students, journalism students and local journalists about the implementation of the Code of Ethics and the self-regulatory processes that have started in Albania.

This project is being developed within the framework of the project “Towards Improvement of Labor Relations and Professionalism in the Albanian Media” supported by the European Union, implemented by the Albanian Media Institute and the International Federation of Journalists (IJF).

Opinion.al and Klan.al, 2 medias that put efforts on ethics

Throughout the tour in newspaper newsrooms, the AMC team stopped today at the editorial staff of klan.al and opinion.al, in the company of journalists Mark Marku and Sokol Shameti. Opinion.al is one of the newsrooms that results in a low violation of ethics, according to Media Council’s monitoring. Journalists of this newspaper were concerned with unfair competition from non-professional portals that attract clicks through unethical news, bombastic titles, and non-professional access.

Klan.al also strives to maintain high ethical standards. The editorial team of klan.al, according to Editor-in-Chief Spartak Koka, has refused more than once to publish non-ethical news although aware that this approach has left them at the forefront of the competition.

Mark Marku, explained that bad journalism seems to bring profits for the moment, but in the long term it drains non-professional media. History has shown that ethical media have the greatest life expectancy in the market and their credibility to the public grows slowly but is steadily.

Sokol Shameti presented the findings of  AMC’s monitoring for the period September-December 2018 – findings which were discussed with the journalists.

The meetings, powered by OSFA funding, were held in a debate and very positive atmosphere.

Opinion.al dhe Klan.al, 2 media që përpiqen për etikën

Gjatë turit nëpër redaksitë e gazetave, ekipi i KSHM ndaloi sot në redaksitë e klan.al dhe opinion.al shoqëruar nga gazetarët Mark Marku e Sokol Shameti. Opinion.al është një nga redaksitë që rezulton me shkelje të ulëta të etikës nga monitorimet e Këshillit të Medias. Gazetarët e kësaj redaksie kishin si shqetësim konkurencën e pandershme nga portalet jo profesionale të cilat kërkojnë klikime me anë të lajmeve jo etike, titujve bombastikë dhe qasjes jo profesionale.

Klan.al gjithashtu përpiqet për të mbajtur standarte etike të larta. Redaksia e klan.al, sipas Kryeredaktorit Spartak Koka, ka refuzuar më shumë se njëherë për të publikuar lajme jo-etike edhe pse të ndërgjegjshëm që kjo qasje i ka lënë ata në bisht të konkurencës.

Mark Marku, shpjegoi se gazetaria e keqe duket sikur sjell fitime për momentin, por në plan afatgjatë ajo skarcon mediat jo-profesionale. Historia ka treguar se mediat etike kanë jetëgjatësi më të madhe në treg dhe besueshmëria e tyre tek publiku rritet ngadalë, por është e qendrueshme.

Sokol Shameti prezantoi gjetjet e monitorimeve të KSHM për periudhën shtator-dhjetor 2018, gjetej të cilat u diskutuan me gazetarët.

Takimet, mundësuar nga financimi i OSFA, u zhvilluan në një atmosferë debati dhe mjaft pozitive.

Complaint: defamation and publication of fake news, breach of privacy that could lead to risks about one’s life.

THE DECISION OF TE BOARD

THE BOARD of Ethics found that the publications filed in the fore-mentioned complaint do breach a number of articles of the Albanian Journalist’s Code of Ethics.

Since the publications are based on the same arguments the recommendation of the Board of Ethics is valid for all of them.

Articles of the code that were breached:

1 –Accuracy and Fairness of Information

Information served in the publications is not verified and misleading.

Some of the conclusions are not based on facts:

“russian portal tsarizm.com”

“…to the chain of the Russian links of Basha is added also the wife of his bodyguard…”

etc.

2 – Distinguishing Fact from Opinion

The accuses against the journalist Taylor are based on opinions disguised as facts, as for example:

“negative writing about Albania”,

“the journalist close to Democratic Party”,

“to do the propaganda of the Democrat Chairman”,

“The journalist that blackens Albania in the russian TV”,

“Tsarizm has published plenty of articles which are aimed at discrediting the Albanian identity. The same thing was also done by Alice Taylor”,

etc.

Besides the direct accusations against Taylor, in general the publications filed in the complaint are filled with suppositions and opinions instead of facts.

9 – Breach of privacy

Because of her writings, it has been a breach of her privacy bringing into the conflict a member of her family.

11 – Incitement of Crime and Violence

By treating her as a “traitor” and a person who “discredits the Albanian identity”, as well as accompanying the publications with her (unauthorised) photos, the journalist might become a target of violence.

13 – Reporting of Court Procedures and the Presumption of Innocence

The Presumption of Innocence in regard of the complainer’s fiancé is not respected when treated as person “who broke the order and public security”. No journalist or media should consider anybody guilty until proven by the Court.

RECOMMENDATION

We recommend that the portals must take the prublications offline.

etj.

2 – Dallimi i Faktit nga Opinioni

Akuzat ndaj gazetares Taylor janë ndërtuar mbi opinione të veshura si fakte, si psh:

“shkrime negative për Shqipërinë”

“gazetarja pranë PD-së”

“për të bërë propagandën e kreut demokrat”

“Gazetarja që nxin Shqipërinë në televizionin rus”, etj.

“Tsarizm has published plenty of articles which are aimed at discrediting the Albanian identity. The same thing was also done by Alice Taylor”

etj.

Përveç akuzave direkte ndaj Taylor, në tërësi informacioni i shkrimeve të sipërcituara është i veshur me opinione e supozime në mungesë të fakteve.

9 – Ndërhyrja në jetën private

Për hir të shkrimeve të veta, është ndërhyrë në jetën private të gazetares dhe është përfshirë në këtë konflikt anëtari i familjes së saj.

11 – Nxitja e Krimit dhe Dhunës

Duke e trajtuar si “tradhëtare” apo “njeri që diskretiton identitin e shqiptarëve” dhe duke e shoqëruar shkrimin me fotot e saj (të paautorizuara), gazetarja mund të bëhet target dhune.

13 – Raportimi i Procedurave Gjyqësore dhe Prezumimi i Pafajësisë

Shkelet prezumimi i pafajësisë së të fejuarit të ankimueses për akuzat e ngritura në media si “nxitës dhune”. Gazetari nuk mund të akuzojë e etiketojë askënd pa u provuar më parë nga gjykata.

REKOMANDIMI

Rekomandojmë që portalet që kanë publikuar këto lajme t’i heqin nga qarkullimi dhe t’i nxjerrin offline.

Description of Complaint:

I was photographed on my work place and the picture ended in the pages of JOQ.al with the comment “[…] at the Trauma Hospital. The Doctor is visiting the patient while talking on the phone… talking and doing injections…”.

The truth is that I was called by the On Service Medic to ask me about the patient. It was not an injection but a thermometer.

Presumed breach: Change of the context of the image to imply abuse of duty while it was a professional communication (as in the photo below).

DECISION OF THE BORD

The Articles of the Code that were Breached:

Article 7. 7. Liability after Publication

“Prior to publishing a comment, or a letter to the editor, where there is a suggestion that it contains serious accusations against a third party, the editorial staff, or the editor, shall investigate if there is any basis to these accusations. Also, the accused party must be afforded the opportunity to respond”.

WE RECOMMEND that the lady be given the chance to express herself. The photo must be republished altogether with the reaction of the victim. Her explanation must be published with the same space and time slot as the acusation.
